These Terms of Service ("Terms") govern your use of the We Unearthed mobile application and website (collectively, the "Service"), operated by We Unearthed LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Nature of the Service
We Unearthed is a wellness and self-reflection application. It is not a medical device, therapeutic service, or substitute for professional mental health care.
Reflections, insights, and suggested acts provided within We Unearthed are personalized using artificial intelligence technology and are not reviewed, approved, or supervised by licensed mental health professionals. The content should not be relied upon as medical, psychological, legal, or professional advice of any kind.

By using We Unearthed, you acknowledge that the application is a self-reflection tool and agree not to use it as a substitute for professional care. We Unearthed and its creators are not liable for actions taken based on content provided within the application.
2. AI-Generated Content
We Unearthed uses artificial intelligence, including services provided by Anthropic (Claude) and OpenAI, to generate personalized reflections, insights, and suggested acts based on user-provided content. This content is generated algorithmically and is not reviewed by human professionals before delivery.
While we implement safety systems including content monitoring, crisis detection, and resource referral, these systems are not infallible. Users should exercise their own judgment and seek professional support when needed.
Journal entries and voice transcriptions are processed to generate reflections. Raw text and voice recordings are stored on the user's device only and are not stored on our servers. Processed content necessary for generating reflections is transmitted to our servers and to third-party AI providers under their respective data processing agreements.
3. International Users
We Unearthed is available internationally. User data is processed on servers located in the United States. By using We Unearthed, international users consent to the transfer of their data to the United States for processing.
For users in the European Economic Area (EEA) or United Kingdom, our legal basis for processing personal data is your explicit consent provided when creating an account. You have the right to access, correct, delete, or export your personal data at any time through the app's Settings screen.
Crisis resources displayed within the app are localized to the user's registered country where available, with international fallback resources for unsupported regions.
4. Eligibility
You must be at least 18 years old to use We Unearthed. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
5. User Accounts
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating your account and to update your information as necessary. You agree to notify us immediately of any unauthorized use of your account.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe upon the rights of others
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for any commercial purpose without our written consent
- Submit content that is harmful, threatening, abusive, or otherwise objectionable
7. Intellectual Property
The Service, including its design, features, content, and branding, is owned by We Unearthed LLC and is protected by copyright, trademark, and other intellectual property laws.
Your journal entries, reflections, and personal content remain yours. We do not claim ownership of any content you create within the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing and improving the Service.
8. Subscriptions & Payments
We Unearthed may offer free and paid subscription tiers. Paid subscriptions are processed through the Apple App Store or Google Play Store. All billing, payment processing, and refund policies are governed by the respective app store's terms.
You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.
9. Termination
You may terminate your account at any time through the app's Settings screen. Upon termination, all server-side data associated with your account will be permanently deleted within 30 days.
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.
10. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE UNEARTHED LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Delaware.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Effective" date at the top of these Terms and, for significant changes, by sending a notification through the App or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
